These Terms of Service ("Terms") govern your use of the BrightCore Grow campaign grading tool ("Grow Tool") provided by BrightCore Ltd ("we", "us", or "our") via the website brightcore.ie/grow.

By using the Grow Tool, you agree to be bound by these Terms. If you do not agree, please do not use the tool.

The Grow Tool is a free AI-powered campaign grading service that allows fitness businesses to upload advertising creative (images), along with optional headline and description text, and receive an automated assessment of the creative's effectiveness.

The grading is generated using artificial intelligence technology provided by Anthropic (Claude). The assessment includes an overall score, dimensional breakdowns, strengths, areas for improvement, and a top priority recommendation.

When you use the Grow Tool, you may provide the following information:

• Your email address
• Uploaded advertising images
• Headline and description text
• Business type (e.g. gym, yoga studio, pilates studio)
• Campaign vibe preferences (tone, energy, audience settings)

We use the data you provide for the following purposes:

• Campaign grading: Your uploaded image and text are sent to Anthropic's Claude AI service for analysis. This is necessary to generate your campaign grade and feedback.
• Email communications: If you consent to receive marketing communications, we will use your email address to send you information about BrightCore products and services. You may unsubscribe at any time via the unsubscribe link in any email.
• Service improvement: We may use aggregated, anonymised data to improve the Grow Tool and our services generally.

The Grow Tool uses Anthropic's Claude AI to analyse and grade your campaign creative. By using the Grow Tool, you acknowledge and agree that:

• Your uploaded images and text will be transmitted to Anthropic's servers for processing.
• Anthropic processes this data in accordance with their own usage policies and terms of service.
• AI-generated assessments are automated and provided for informational purposes only. They do not constitute professional marketing advice.
• Results may vary and are not guaranteed to reflect actual campaign performance.

You retain ownership of all images and text you upload to the Grow Tool. By uploading content, you represent and warrant that:

• You own the content or have the right to use it.
• The content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights.
• The content does not contain unlawful, harmful, threatening, abusive, or otherwise objectionable material.

You grant us a limited, non-exclusive licence to process your uploaded content solely for the purpose of providing the grading service.

The Grow Tool is provided with a daily free usage limit. We reserve the right to modify, restrict, or discontinue access to the tool at any time, with or without notice.

The Grow Tool is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the tool will be uninterrupted, error-free, or that the AI-generated results will be accurate, complete, or suitable for any particular purpose.

Campaign grades and recommendations are generated by AI and should be used as one input among many when making marketing decisions.

To the maximum extent permitted by law, BrightCore Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Grow Tool, including but not limited to loss of profits, data, or business opportunities.

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Your email address is processed on the basis of your consent (for marketing communications) and our legitimate interest in providing the grading service.

You have the right to access, rectify, erase, or restrict the processing of your personal data. To exercise these rights, contact us at hello@brightcore.ie.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Grow Tool after changes constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
